A limited warranty
Nothing leaves us under the Proper Favor seal unless we would stand behind it. This page sets out what that means and is part of our Terms of Service. Your proposal identifies the piece, its disclosed condition and the coverage that applies; it may add protection but may not reduce this published Guarantee. Your mandatory legal rights remain available.
This limited warranty is given by Proper Favor. Warranty contact: curator@properfavor.com; (702) 483-0121; 9620 S Las Vegas Blvd, Suite E4 #1176, Las Vegas, NV 89123.
Part one: the Proper Favor Guarantee
What it covers
For an object or commission we sell to you, including its stated components, if the piece:
1. arrives damaged;
2. has a fault in its materials or workmanship that appears within 12 months of delivery; or
3. arrives with wrong engraving or wrong details, meaning it differs from what you approved in the proposal, through our error or our maker's,
we put it right, at our cost.
What we will do
We will repair the piece, provide a suitable replacement or refund the amount paid for the affected favor, at our reasonable choice, within a reasonable time. We pay the reasonable cost of collection, insured return shipping, repair or remake, duties and redelivery needed to honor a valid claim. A refund includes the credited request deposit and applicable tax for the refunded favor. Our refund obligation under this voluntary Guarantee does not exceed the amount paid; the collection and shipping costs we promise are paid in addition and are not deducted from the refund. This does not limit any greater remedy required by law.
If a repair does not put it right, we will replace the piece or refund the price paid.
When to tell us
- Damage on arrival or wrong engraving or details: please tell us within 7 days of delivery, or as soon as reasonably possible if the problem was not apparent then.
- Perishables that arrive damaged or spoiled: please tell us within 48 hours, with photographs where reasonably available. Prompt notice is especially helpful because their condition changes quickly.
- Faults that appear later: the fault must appear within the 12-month coverage period, and you should tell us promptly after discovering it. A short delay in notice, missing photograph or missing packaging does not automatically defeat a valid claim. We consider whether the delay materially prevents verification, and any longer period or remedy required by law applies.
Who can ask
The client or the original recipient may ask for help under this Guarantee. We handle recipient enquiries discreetly and disclose price information only when necessary to honor their legal rights. A refund is normally made to the original payer. Nothing here excludes another person whom applicable law entitles to enforce a warranty.
What it does not cover
- Taste or a change of mind. The guarantee covers faults, not preferences. For returns of stock objects, see Refunds and Cancellations.
- Normal wear, and the natural aging of materials such as leather, wood, metal and paper.
- Natural variation in hand-made pieces and natural materials, as described in the proposal.
- Anything you approved in writing, such as engraving text or a design, when we made it exactly as approved.
- Damage caused after delivery by an accident, misuse, neglect, or a repair or alteration not performed by us or our maker. An unrelated repair or the use of another service provider does not, by itself, void this Guarantee.
- The described condition of older pieces. Wear, restoration and imperfections described in the proposal are part of the piece.
- Experiences. They are provided by the operator named in the proposal, under its terms. If an experience goes wrong, we work on your behalf to put it right and to recover what we can (see section 8 of the Terms).
- Wine and spirits, which are sold by a licensed partner under its own terms. We help with any problem on your behalf.
How to make a claim
1. Write to curator@properfavor.com, or to your curator, with your invoice number (it begins "PF") and a short description.
2. For damage, send photographs of the piece and packaging if reasonably available, and retain the packaging if practical until we advise you. Contact us before arranging a repair or return so we can coordinate it safely.
3. We reply within one business day and arrange an insured collection, or a visit, at our cost.
4. We tell you what we will do, and by when.
Part two: the authenticity guarantee
What it covers
For antiques, vintage and pre-owned watches, and rare books that we sell to you, we guarantee that the piece materially matches the express attribution in the proposal and maker's note as to maker or author, period or date, and material. Any uncertainty, such as "attributed to" or "circa", must be clearly stated before approval and applies only to that identified attribute. A generic provenance qualification does not excuse a material misdescription.
For how long, and for whom
Five years from delivery. The guarantee benefits the client and the original recipient. It does not pass to later owners.
What we will do
If the piece is established not to be authentic as guaranteed, we refund the amount paid for the affected favor, including applicable tax and its credited deposit, after its return. We arrange and pay for reasonable insured return shipping. Normal aging, careful use or an examination reasonably needed to establish the claim does not by itself defeat it; material damage or alteration unrelated to the authenticity issue may affect the remedy only as the law permits. Refund is the remedy under this voluntary authenticity guarantee, without excluding other mandatory remedies.
When to tell us, and what we need
For this voluntary authenticity guarantee, the issue must first be discovered within five years after delivery. Tell us within 90 days after you first have reason to doubt the piece, even if that notice period ends after the five years. Provide reasonable supporting information; an opinion from a suitably qualified independent expert may help. We may obtain a second opinion at our cost. We consider a reasonable extension where circumstances prevent timely notice and the claim can still be fairly assessed. Applicable statutory rights and time limits remain unchanged.
Provenance
We describe provenance from our research and the dealer's records and identify material uncertainties. We do not promise a complete chain of ownership unless we expressly agree one. This does not exclude an express description, conceal an adverse fact we know, or limit a claim for misdescription, fraud or lack of good title.
Watches: the parts note
Every vintage or pre-owned watch comes with a written parts and condition note describing what is known to be original, serviced or replaced, and what could not reasonably be established. A part is not represented as original if the proposal identifies it as replaced or its status as unknown. We do not treat all parts that are commonly serviced as automatically excluded without disclosure. Any transferable service warranty is identified in the proposal. None of this limits the 12-month materials and workmanship coverage for an otherwise covered defect.
Your other rights
Implied warranties. Any implied warranties of merchantability, fitness for a particular purpose or otherwise apply as provided by law. The reporting requests above do not shorten those rights or any statutory period for bringing a claim. The express 12-month and five-year coverage periods describe the separate promises in this Guarantee.
Incidental and consequential damages. Subject to Terms section 19.1, we exclude incidental and consequential damages arising from this Guarantee or an implied warranty to the extent lawful. This does not exclude the costs we expressly promise to pay to honor a claim. Some states do not allow the exclusion or limitation of incidental or consequential damages, so this exclusion may not apply to you.
This guarantee gives you specific legal rights, and you may also have other rights, which vary from state to state. Nothing on this page limits any right you have under the law that cannot be limited.
