Discretion is the heart of what we do. This policy explains, plainly, what we collect, why, who else handles it, how long we keep it, and what you can ask of us.
The short version
- We collect only what we need to choose, make and deliver a gift, and to be paid for it.
- Your details, and the recipient's, go only to the people who make and deliver your favor, the services that run our studio, and others for the limited purposes described below.
- We never sell personal information, and never use it for advertising.
- We send no marketing email. If we ever offer a newsletter, you will have to choose it, separately; it will never be pre-ticked.
- This site sets no cookies and runs no analytics today. If that ever changes, we will update this policy and our Cookies page first.
- Notes about the person you are giving to are removed within 90 days after delivery or cancellation, subject to the limited legal-retention exceptions in section 7. Unnecessary health information is handled sooner under section 4.
- Write to privacy@properfavor.com about anything on this page. We aim to reply within 30 days and comply with any shorter deadline that applies.
1. Who we are
Proper Favor, 9620 S Las Vegas Blvd, Suite E4 #1176, Las Vegas, NV 89123, decides how the information described here is used.
Privacy questions and requests: privacy@properfavor.com.
2. What we collect
2.1 When you send a request
The request form asks for:
- your name and email address;
- how you would like us to reach you (email, phone call or secure message), and your phone number if you choose a call or a secure message;
- the occasion, and the date or rough window for delivery;
- who the gift is for (a relationship is enough; no names are needed at this stage);
- the recipient's interests and preferences, and any instructions on discretion; please share only what is needed for the gift;
- a budget band, and where the gift is going (city and country is enough at this stage);
- for a corporate gift, the company name and any gifting restrictions you provide; and
- if you came from the gift finder or the Collection, the choices you made there.
2.2 The gift finder
Your answers in the finder stay in your own browser's session storage, which normally lasts for the current tab session. Browser restore features may preserve it. Nothing you choose in the finder leaves your browser unless you send a request, and then only as part of that request.
2.3 As we work together
- Correspondence: emails, calls and secure messages with your curator.
- Calls and texts: when you call or text us, we keep the number, message and any voicemail so we can respond and arrange your favor. Our communications service providers handle these records. We use the contact channel you request and send no marketing texts. You may ask us to stop texting at any time, including by replying STOP. Before recording a live call, we will give notice and obtain any consent required by law.
- Delivery details: the recipient's name, delivery address, and any access or timing instructions.
- Proposal and approval records: the request-service terms and your acceptance, any proposal or auction authorization, your approval, any separate arbitration acceptance, and the Terms and warranty versions supplied to you.
- Payment records: your name, email, company and billing address if you give one, the invoice, payment status and limited payment identifiers. Full card details are entered on Stripe's own secure pages, not on our site. We may receive the transaction and bank details needed to identify or reconcile a bank transfer. Please do not send full card details by email or message.
- Checks: if we ask you to confirm your identity or the order, the information needed for that check.
- For corporate clients: lists of recipients you send us.
2.4 Technical information
When you visit the site, our web host, Netlify, records standard server information: your IP address, browser type and the page requested. We do not use it to identify or follow visitors.
2.5 What we do not collect
No cookies, analytics, advertising pixels, social-media plug-ins, or third-party fonts or scripts on this site. See our Cookies page.
3. Information about recipients and other people
Giving a gift means telling us about someone else. When you do:
- please share only what we need, and only what you are entitled to share;
- we use a recipient's details to choose, make and deliver the favor, handle guarantee claims, and meet the limited legal and record-keeping purposes described in this policy;
- we contact a recipient for those service purposes, at the recipient's own request, or as the law requires, using an appropriate contact channel; and
- we never publish who receives a gift.
A recipient who would like to know what we hold about them, or to have it corrected or deleted, can write to privacy@properfavor.com. We will verify the request, protect other people's information and honor applicable privacy rights. A giver's preference for a surprise does not limit the recipient's legal rights.
4. Health information
We do not request medical records, diagnoses or treatment details to choose a gift. Please describe preferences without explaining anyone's medical history. If we receive unnecessary health information, we restrict access, do not use it to select the favor, and remove it from our active records as soon as practicable after identifying it, unless the law requires preservation. If a particular experience needs health-related or accessibility information, we will arrange an appropriate process with the person concerned before collecting or sharing it; where possible, that person will provide it directly to the experience provider.
5. How we use information
We use personal information to:
- answer your request and prepare a proposal;
- source, buy, commission, make, wrap and deliver your favor;
- arrange experiences with the operators who provide them;
- invoice you, take payment and issue refunds;
- carry out fraud and identity checks;
- honor the guarantee, returns and exchanges;
- keep the records the law requires, including tax records;
- respond to disputes and chargebacks; and
- comply with the law.
We do not use personal information for marketing, advertising or sale, or to make solely automated decisions that have legal or similarly significant effects. We publish a client's gift only with that client's written permission and in anonymized form; if a recipient could be identified, we also obtain that person's permission.
6. Who else handles it
6.1 The people who make and deliver your favor
Makers, dealers, specialist couriers, experience operators and licensed wine and spirits partners receive only what each needs to do its part: usually the recipient's name and delivery address, engraving or personalization details, and timing. We require providers acting on our behalf to protect this information, keep it confidential and use it only for the agreed service. Independent providers may also keep records they need for their own legal obligations, under their privacy notices and applicable law.
6.2 The services that run our studio
| Service | What it does for us | What it receives |
|---|---|---|
| Netlify, Inc. (US) | Hosts the site and receives and stores request-form submissions. Sends us an email notification of each one, using its email provider, Twilio SendGrid. | Every form submission; visitor server logs. |
| Automattic Inc., through its Akismet service, on Netlify's behalf (US) | Netlify screens every form submission for spam with Akismet. | The content of each submission, for spam screening. |
| Google LLC (US), Google Workspace | Our email and documents. | Your request (as an email notification) and all our correspondence. |
| Stripe, Inc. (US) | Sends invoices and takes payment on its own secure pages. | Your name, email, company, billing address, the invoice, and your payment details. Stripe also uses some of this as an independent business, for fraud prevention and its own legal duties, under Stripe's privacy policy. |
| Cloudflare, Inc. (US) | Provides our domain name service. | The technical lookups that connect your browser to our site, not the content of your visit. |
| Signal Messenger LLC (US) | Our secure-message channel is provided through Signal, if you choose it. | The account and contact information needed to provide the service and encrypted message content. Signal cannot read the contents of our end-to-end encrypted messages; those contents remain accessible on the participants' devices and in any records we retain. |
| Our communications service providers | The private line, for calls, texts and voicemail. | Your number, your messages and any voicemail. |
6.3 Other disclosures
- Card issuers and payment networks, in a dispute: the approved proposal, the invoice and proof of delivery.
- Insurers, for a delivery claim.
- Professional advisers, such as our lawyers and accountants, in confidence.
- Authorities, where the law requires it, or to protect someone's safety.
- A successor business, if Proper Favor is sold or reorganized, under this policy.
6.4 What we never do
We never sell personal information, never share it for cross-site or targeted advertising, and never give it to data brokers.
7. How long we keep it
| Information | How long |
|---|---|
| Form submissions stored at Netlify | Deleted every month, once the request is in our inbox. |
| A request that does not become a favor | Inquiry details are deleted 12 months after our last contact, except for limited records needed for a legal obligation or unresolved claim. Request-deposit, refund and acceptance records follow the financial-record schedule below. |
| Notes about a recipient, discretion instructions and anything sensitive | Removed within 90 days after delivery or cancellation, unless a specific legal obligation or claim requires limited preservation. Unnecessary health information is handled sooner under section 4. |
| Recipient lists from corporate clients | Deleted within 90 days after the last delivery or cancellation, except for limited transaction records retained as described below. |
| Client and financial records: request-deposit and refund records, proposals, approvals, invoices, payment and delivery records, and the recipient's name and delivery address needed with those records | Kept for 7 years after completion or cancellation of the relevant request or favor, then deleted, unless a specific legal obligation, unresolved claim or legal hold requires longer retention of particular records. |
| Calls, texts, voicemail and secure-message conversations (Signal) | Kept as long as needed to respond and arrange the favor. Relevant proposal, approval, payment, delivery and dispute records follow the request or client-record periods above; routine recipient notes follow the 90-day period. Copies in communication accounts are included in the deletion process. |
| Privacy requests and our replies | 24 months, as a record that we answered. |
| Server logs | Kept by Netlify under its own retention practice. |
| Akismet spam screening | Kept by Automattic under Netlify's arrangements with it. |
| Stripe payment records | Kept by Stripe as the law requires of it. |
8. Security
We use reasonable administrative, technical and physical safeguards appropriate to the information we hold and limit access to people who need it. Full payment credentials are entered on Stripe's pages rather than our site. Two-step verification is on for our email, hosting and payment accounts. If a security incident affects your information, we will notify you as the law requires.
9. Your choices and rights
Wherever you live, you may ask us to:
- tell you what personal information we hold about you, and give you a copy;
- correct it;
- delete it, subject to exceptions permitted by applicable law, such as necessary transaction, security, legal-obligation or legal-claim records; and
- withdraw any permission you gave, such as permission to tell the story of a favor.
Write to privacy@properfavor.com. We may need to confirm your identity and authority first, using information proportionate to the request. We aim to respond within 30 days and will comply with any shorter deadline; if the law permits more time, we will explain the reason and timing. We may limit a request where the law permits, including to protect another person's information, and will explain any refusal. You may use an authorized agent with proof of authority. To appeal a refusal, reply to our decision or write to privacy@properfavor.com with the subject 'Privacy appeal'; we will review it and respond within the period required by applicable law, with information about contacting the relevant regulator if the appeal is denied. We do not discriminate against anyone for exercising a privacy right.
10. Nevada residents
We do not sell covered information, as Nevada law defines a sale (NRS 603A.333). Nevada residents may still send a request not to have their covered information sold to our designated request address, privacy@properfavor.com. We respond within 60 days, as Nevada law requires, and aim to do so within 30.
11. California residents, and Do Not Track
This policy describes the categories of personally identifiable information we collect, the third parties we share it with, how you can review and request changes to it (section 9), and how we will tell you of changes (section 15).
Do Not Track and Global Privacy Control. We do not use this site to track visitors across unrelated websites, sell personal information or share it for targeted advertising. We do not change the site's operation in response to Do Not Track because we do not conduct that tracking. A Global Privacy Control signal is consistent with our existing no-sale and no-targeted-advertising practices; where the law requires a response to an opt-out signal, we honor it. Stripe's separate payment pages are described in section 6.2 and our Cookies page.
12. Other US states
Privacy laws differ by location and by the information and activities involved; some protections apply to small businesses as well. We offer the request process in section 9 to everyone and honor any additional rights that applicable law gives you, including rights to a portable copy, to object to or restrict particular processing, and to appeal a refusal.
13. Children
Our service is for adults. You must be 18 or over to submit a paid request or approve a proposal. The site is not directed to children under 13, and we do not knowingly collect personal information directly from them; if we learn that we have, we take the steps required by law, including deletion where appropriate. For a gift to a child, use a parent or guardian's delivery contact and share only the information needed for that gift, such as an age range and interests. Where parental permission is required, we obtain it before processing the child's information.
14. Clients outside the United States
We are based in the United States, and our service providers process information here. We consider international requests case by case, and some favors are made, delivered or experienced abroad. Before you commit, we identify any delivery or service restriction. We share only what the relevant maker, courier or host needs, as section 6 describes.
Where EU or UK data protection law applies, Proper Favor is the controller of the information described in this policy. We use information to take steps you request before a contract and perform our contract with you; to meet legal obligations; and for our legitimate interests in arranging gifts, supporting recipients, protecting the business against fraud and resolving claims, balanced against the affected person's rights. We obtain consent where the law requires it. Recipient information ordinarily comes from the giver or the giver's organization. A recipient is not treated as a party to the giver's contract merely because we hold their details.
You may request access, correction, deletion, restriction and portability where applicable, withdraw consent without affecting earlier lawful processing, and object to processing based on legitimate interests. Contact privacy@properfavor.com. You may also complain to the relevant European supervisory authority or the UK Information Commissioner's Office at ico.org.uk. We do not make solely automated decisions about you that have legal or similarly significant effects. Information needed to arrange or pay for the favor is necessary to provide the service; without it we may be unable to proceed.
Where a transfer is subject to EU or UK transfer restrictions, the applicable notice will identify the adequacy decision or contractual safeguards used and how to obtain a copy. Before undertaking processing that requires an EU or UK representative or additional local disclosures, we will provide those details in a supplemental notice.
15. Changes to this policy
If we make a material change, we will post the new version here with a new effective date and, where appropriate, notify affected clients directly. We will provide any additional notice and obtain any consent required by law before using previously collected information for a materially different purpose.
